1. My current fee rates are available on application. An average time charged for perusal of medical records and preparation of a full report is 6 hours. Attending meetings with solicitors/counsel/other experts and appearing in court is charged at the same hourly rate as report writing. Travelling time is charged at half this rate. I am not VAT registered. My fees are reviewed on 1 January each year and may be subject to increase.
  2. Liability to pay my fees and expenses lies with my client and not a claimant, defendant or an insurer.
  3. Cancellation fees are payable in the event of cancellation or rescheduling of the whole or part of a booked court appearance at less than 4 weeks’ notice.
  4. Fees relating to court attendance include waiting at court and apply even if I am not required to give oral evidence.
  5. Reasonable expenses at cost will be invoiced in addition to the above.
  6. Invoices are due for payment for reports in advance of delivery. For subsequent work, billing will be done periodically and I expect payment within 28 days of delivery.
  7. Should accounts not be settled within the agreed period, I reserve the right to charge interest on any sum that remains outstanding for more than 28 days after delivery of the invoice until full settlement is received. The interest will be calculated at the rate of 2% per month, or part of a month, in compound fashion. This practice is according to the Late Payment of Commercial Debts (Interest) Act 1998 as amended by the Late Payment of Commercial Debts Regulations 2002.
  8. I am not prepared to have my accounts subjected to assessment or taxation.
  9. I will use my experience, care and skill in fulfilling instructions to the best of my ability. In the event of dissatisfaction with my services, reasons should be put to me in writing.
  10. I expect to be given full, clear and proper instructions and to be supplied with copies of all relevant documents. I will ask for clarification or missing documents if necessary.
  11. I expect to be provided with copies of all Court Orders that might affect me.
  12. I expect to be informed when the case is concluded either by settlement or trial
  13. I expect to be provided with comprehensive instructions including whether the matter is pre-trial advice or litigation is likely and all timetabling information as far as is practicable including track allocation. I reserve the right to terminate an agreement, and to charge for work undertaken to that point, if I am provided with information which is false or misleading and which may compromise my duty to the court.
  14. The nature of my duty to the court under Part 35 Civil Procedure Rules is understood and accepted (England and Wales only).
